1. Introduction

Welcome to Winify ("we," "our," or "us"). By accessing or using our website, services, and tools (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you must not access or use the Service.

2. The Service (Platform/Venue Role)

Winify operates as a platform and venue that allows users ("Hosts") to create and manage giveaways, contests, and sweepstakes ("Campaigns") and allows other users ("Entrants") to participate in them.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement. Giveaways may be prohibited or restricted in certain countries or jurisdictions. It is your responsibility to ensure compliance with your local laws.

4. Host Responsibilities

If you use the Service to create or host a Campaign, you agree that:

• You are solely responsible for the operation and strict compliance of your Campaign with all applicable laws, rules, and regulations (including UK CAP Code and relevant gambling laws).
• You will conform to the promised rules and distribute prizes to winners promptly and fairly.
• You indemnify and hold Winify harmless from any claims, damages, or losses arising from your Campaign.
• You will not create fake, misleading, or impossible-to-win Campaigns.

5. Entrant & User Conduct

When using the Service, you agree NOT to:

• Use bots, scripts, or automated means to enter giveaways or manipulate results.
• Create multiple accounts to gain an unfair advantage ("farming").
• Harass, abuse, or harm other users or Start fake disputes.
• Post illegal, offensive, or infringing content.

We reserve the right to suspend or terminate your account immediately if you violate these rules.

6. Intellectual Property

The Winify name, logo, design, and platform code are the intellectual property of Winify. User-generated content (Campaign text, images) remains the property of the respective user, but you grant us a license to display and promote it on the Platform.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY FAILURE OF A HOST TO DELIVER A PRIZE.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in England.
