Terms of Service

1. Introduction

Welcome to Winify ("we," "our," or "us"). By accessing or using our website, Creator Studio, bots, API, software, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy and our Disclaimers. Please read them carefully. If you do not agree to these Terms, you must not access or use the Service.

We are currently formalising our company structure — for details of the legal entity providing the Service, please contact us via our official support channels and we will provide them.

2. What Winify Is — and Is Not

Winify operates exclusively as a Software-as-a-Service (SaaS) provider and creator toolset tailored for the iGaming and content creation industries. We provide tools—including but not limited to Giveaway and winner-picking systems, Roll Check, bot and entry checks, the Winify Image AI, Livestreaming integrations and chat bots (e.g., Kick), Videos & Clips, Discord and Telegram bots, Casino Reviews, Tier Lists, Creator Pages and Custom Websites, Affiliate Codes, Rewards, the Wager Database, Leaderboards, sponsorship and influencer tools, and the Winify X API (collectively, "Tools")—that allow users ("Creators" or "Hosts") to engage with their audience ("Entrants").

3. Eligibility — 18+ Only

You must be at least 18 years old, or the legal age for gambling in your jurisdiction if that is higher, to use the Service. By creating an account or using the Service you represent and warrant that you meet this requirement and that using the Service is lawful where you are. We may ask you to confirm your age and may suspend or close any account we reasonably believe belongs to someone under age.

If you are a Creator, it is your sole responsibility to implement appropriate age-gating, KYC (Know Your Customer), or jurisdictional restrictions for your Campaigns as required by the laws that apply to you and your audience.

4. Your Account

• You sign in through a third-party account (for example X). You are responsible for keeping that account secure and for everything done through your Winify account, API key and connected bots.
• One person, one account. You must not create or use multiple accounts to gain an advantage, evade a suspension, or get around plan limits.
• The information you give us must be accurate, and you must not impersonate anyone else.

5. Creator (Host) Responsibilities — Prizes, Rewards & Payouts

When using Winify's Tools to create or host a Campaign (e.g., Giveaways, Leaderboards, Contests, Rewards), you agree that:

• You are the promoter of your Campaign and you alone are responsible for paying every prize, reward, bonus or payout you offer — in full, on the terms you advertised, and promptly.
• You are solely and entirely responsible for the operation and strict compliance of your Campaign with all applicable local, national, and international laws, rules, and regulations (including but not limited to gambling, lottery and prize-promotion law, tax, consumer law, advertising standards such as the UK CAP Code, and the policies of any social media platform you run it on).
• You will follow the rules you published, pick winners fairly, and resolve any disputes directly with Entrants.
• You will not create fake, misleading, or impossible-to-win Campaigns, and you will not advertise a prize you cannot or do not intend to pay.
• You will clearly disclose any sponsorship, affiliate or other commercial relationship behind your content as the law requires.
• You acknowledge that Winify provides only the software facility; any promises or obligations made in your Campaigns are binding upon you alone.

6. Entrant & User Acknowledgment

When participating in Campaigns hosted by Creators via the Service, you ("Entrant") agree and acknowledge that:

• You are entering into an agreement solely with the Creator/Host, not with Winify.
• Winify assumes zero liability for undelivered, late, reduced or misdescribed prizes, rigged or inaccurate leaderboards, or any dispute between you and the Creator.
• Anything you send a Creator to receive a prize (a wallet address, a casino username, payment details) is sent at your own risk and is the Creator's responsibility, not ours.
• Winify will never ask you to pay to "release" a prize, and will never ask for your password, seed phrase or private keys. Anyone who does is not Winify.
• You will not use bots, scripts, or automated means to enter giveaways or manipulate results.
• You will not create multiple accounts to gain an unfair advantage ("farming").
• You are responsible for any tax due on anything you win.

We reserve the right to suspend or terminate any account (Creator or Entrant) immediately if you violate these rules.

7. Creator Studio — Tool-Specific Terms

These terms apply to each Tool in addition to everything else in these Terms. In every case the Creator, not Winify, is responsible for how a Tool is used and for what is promised to an audience through it.

7.1 Giveaways, winner picking and "provably fair" draws

• Winner-picking Tools select from the entries we were able to collect at the time of the draw. Third-party platforms limit, hide, delay and change the data they expose, so we cannot guarantee that every entry was collected, that every entrant was genuine, or that an entry requirement was checked correctly.
• A "provably fair" result shows that the selection from that pool was random and can be recomputed. It is not a guarantee that the pool was complete, that the Campaign was lawful, or that the Creator will pay.
• Scheduled and automatic rolls depend on third-party services and may run late or fail. Verification codes, rerolls and winner announcements are conveniences for the Creator; they do not transfer any responsibility to Winify.

7.2 Roll Check, bot checks, entry filters, statistics, Hall of Fame and Tier Lists

• These features produce automated indicators from publicly available information. They can be wrong, incomplete or out of date. A result such as "no roll found", a bot or regional signal, a ranking or a statistic is not a statement of fact about any person and is not an accusation of fraud, dishonesty or wrongdoing.
• Do not rely on them as the only basis for a decision about another person. If a result about you is wrong, contact us and we will look at it.
• Tier Lists and reviews made by users are those users' own opinions, not Winify's.

7.3 Winify Image AI and other AI features

• Images and analysis are generated by third-party AI models and are provided as-is. Output may be inaccurate, may resemble existing works, and is not guaranteed to be unique or free of third-party rights. You are responsible for your prompts, your reference images and how you use the output.
• You must not use AI features to create content that is unlawful, deceptive, defamatory or sexually explicit, that depicts a real person without their permission, that uses a brand you have no right to use, or that would breach advertising rules (for example gambling content likely to appeal to under-18s or that misrepresents the chance of winning).

7.4 Live streaming and chat bots (Kick, Discord, Telegram)

• Our bots only act in channels, servers and chats where a Creator or admin has added or authorised them, and they act on that person's instructions. The Creator is responsible for their stream, their chat, any chat giveaway they run, and for complying with the rules of the platform they stream on.
• Stream status, viewer counts and chat features depend on those platforms and may be delayed, inaccurate or unavailable.

7.5 Videos & Clips

• You may only add channels, videos and clips that you own or have the right to share. Content stays hosted on, and subject to the terms of, the platform it came from; we show embeds, thumbnails, metadata and links.
• We may categorise, age-flag, rank, hide or remove any video at our discretion.

7.6 Rewards, Wager Database, Leaderboards and Contests

• All wager, ranking and reward data is supplied by the Creator — typed in, imported from a file, or pulled from an integration the Creator configured. Winify does not verify it and is not responsible for its accuracy, for any leaderboard position, or for any payout based on it.
• The Creator confirms they are entitled to hold and upload that data (including any data about their audience), and is responsible for any endpoint, credential or API key they connect. Do not connect a source you are not authorised to use.
• Winify is not a party to any relationship between a Creator, their audience and a casino or other operator.

7.7 Affiliate Codes, casino reviews and partner links

• Offers, bonuses and codes shown on the Service belong to third-party operators and are subject to those operators' own terms, eligibility rules and availability. We do not control or guarantee them.
• Some links on the Service are affiliate or sponsored links: Winify or the Creator may be paid if you click, sign up or play.
• Creators must not promote gambling to anyone under 18 or into a jurisdiction where it is unlawful, and must make advertising identifiable as advertising.

7.8 Creator Pages, Custom Websites and custom domains

• The Creator is the publisher of their page or website and is responsible for everything on it, including any legal notices, age warnings and disclosures the law requires of them. Enabling a Winify-provided footer or template does not make your site compliant.
• You must own or control any domain you connect. We may unpublish a page or disconnect a domain that breaks these Terms.

7.9 Sponsorships, "Get Sponsored" and the Influencer Network

• Winify helps sponsors and Creators find each other and exchange information. Any deal is a contract between the sponsor and the Creator only. We do not guarantee that a deal will be offered, that anyone will be paid, or any reach, engagement or result. Audience figures we show are estimates.

8. Winify X API

The Winify X API is an independent developer service offered by Winify. It is not an official X product and is not provided, reviewed, approved or supported by X Corp.

• Your use is your responsibility. You must use the API, and anything you obtain through it, lawfully — including data-protection, privacy, anti-spam and consumer law — and in line with any third-party terms that apply to you. You act as an independent controller of any personal data you retrieve.
• You must not use the API to spam, harass, stalk, surveil or profile people; to infer sensitive information about individuals; to sell or broker personal data; to manipulate a platform; or for anything unlawful.
• Keep your API key secret. You are responsible for every call made with it.
• Data is returned as-is. It may be incomplete, delayed, or inaccurate. Endpoints depend on third parties and may change, be rate-limited, or stop working without notice. We offer no uptime or accuracy guarantee, and we may change, limit or withdraw any endpoint at any time — including where a platform changes its access, at the request of a platform or rights holder, or where the law requires.
• Usage is prepaid and charged at the rates shown on the API page at the time of each call. Free or promotional balance has no cash value.
• We may throttle, suspend or revoke a key that we reasonably believe is being abused or is putting the Service at risk.

9. Third-Party Platforms — No Affiliation

Winify is an independent service. We are not affiliated, associated, authorised, endorsed by, sponsored by, or in any way officially connected with X Corp. or Twitter, Inc., or any of their subsidiaries or affiliates. The same is true of Kick, YouTube and Google, Discord, Telegram, Twitch, and every casino, sportsbook or other brand that appears on the Service. "X", "Twitter", "Tweet" and every other third-party name and logo are trademarks of their respective owners, used only to describe what our tools work with.

Campaigns run through Winify are in no way sponsored, endorsed, administered by, or associated with X / Twitter or any other platform. Your use of those platforms remains subject to their own terms and policies, and you release each of them from any responsibility for a Campaign run through Winify. Those platforms can change or withdraw features at any time; we are not responsible for any Tool that stops working as a result.

10. Gambling Content & Responsible Gambling

• The Service contains content about gambling made by Creators and partners. Nothing on the Service is financial, legal or betting advice.
• Gambling laws differ by country and state. It is your responsibility to check that anything you choose to do on a third-party gambling site is legal where you are. We do not represent that any operator shown on the Service is licensed or available in your location.
• Past wins, clips of big wins, and leaderboard results are not typical and say nothing about your own chances. The odds are always against the player.
• Any gambling you do happens on a third party's site, under their terms, at your own risk. Winify is not liable for any loss you make there.

11. Payments, Premium and Credits

• Prices are shown at checkout. Card payments are handled by our payment processor; crypto payments are made directly on-chain.
• Subscriptions paid by card renew automatically each billing period until you cancel. Cancelling stops future renewals; your plan stays active until the end of the period you have already paid for.
• A "lifetime" plan lasts for as long as Winify continues to offer that plan and operate the Service. It is not a promise that the Service or any particular feature will exist forever, and it is personal to your account.
• Plan limits, allowances and features may change over time.
• Crypto payments cannot be reversed. You are responsible for sending the exact amount, of the right asset, on the right network, to the address shown. Funds sent incorrectly may be lost and we may not be able to recover or credit them.
• Except where the law gives you a right to a refund, payments, credits and top-ups are non-refundable. Nothing here affects your statutory rights as a consumer.

12. Acceptable Use

You must not, and must not help anyone else to:

• use the Service for anything unlawful, fraudulent or deceptive, including scams, fake giveaways or impersonation;
• target or advertise gambling to anyone under 18;
• harass, threaten, defame or dox anyone, or post content that is hateful, sexually explicit or infringes someone else's rights;
• probe, scrape, overload, reverse engineer or get around the security or limits of the Service, other than by using the API as documented;
• upload malware or interfere with other users' use of the Service;
• misrepresent the Service as your own or as an official product of any third-party platform.

13. Intellectual Property & Content

The Winify name, logo, design, and platform code are the intellectual property of Winify. User-generated content (Campaign text, images, videos, pages) remains the property of the respective user, but you grant us a worldwide, non-exclusive, royalty-free licence to host, display, adapt for formatting and promote it on and in connection with the Service. You confirm you have the rights needed to grant that licence.

We do not pre-screen user content and are not responsible for it. If you believe something on the Service infringes your copyright or other rights, or is unlawful, contact us via our official support channels with the link and the reason, and we will review it and remove it where appropriate.

14. Indemnification

THE SERVICE AND EVERY TOOL ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, COMPLETE OR FIT FOR ANY PARTICULAR PURPOSE, OR THAT ANY RESULT, DRAW, CHECK, STATISTIC OR DATA IT PRODUCES IS CORRECT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY FAILURE OF A CREATOR (HOST), SPONSOR OR PARTNER TO DELIVER A PRIZE, PAY A REWARD OR HONOUR A DEAL; (D) ANY GAMBLING OR OTHER ACTIVITY YOU UNDERTAKE ON A THIRD-PARTY SITE; (E) ANY ACT, OMISSION, CHANGE OR OUTAGE OF A THIRD-PARTY PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (II) £100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or your statutory rights as a consumer.

17. Suspension & Termination

You may stop using the Service at any time. We may suspend, restrict or close an account, remove content, or revoke an API key at any time if we reasonably believe these Terms have been broken, if required by law or by a third-party platform, or to protect the Service or its users. Sections that by their nature should survive termination (including 5, 6, 9 and 13–16) do so.

18. Changes to the Service and These Terms

We may change, add or remove features at any time. We may update these Terms; when we do we will change the "Last Updated" date above. Continuing to use the Service after a change means you accept the updated Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in England, except that if you are a consumer you may also have the right to bring proceedings in the country where you live.

20. General

If any part of these Terms is found to be unenforceable, the rest remains in effect. Our not enforcing a term is not a waiver of it. These Terms, the Privacy Policy and the Disclaimers are the whole agreement between you and Winify about the Service. You may not transfer your rights under these Terms; we may transfer ours as part of a reorganisation or sale of the Service.
